What is ISF in shipping?

The ISF (Importer Security Filing ) is required by Customs and Border Protection (CBP) for sea cargo imports into the USA. It involves submitting specific shipment details before loading the cargo onto a cargo ship.

Typically, the ISF filing includes import information from each point in the transportation process. This data can help identify high-risk shipments, combat smuggling, and enhance cargo safety and security.

Who is in charge of Import Security Filing?

As per the Code of Federal Regulations 19 CFR 149.2(a), the ISF Importer is ultimately responsible for transmitting and adhering to CBP requirements.

The ISF Importer is the party delivering the goods to arrive at a U.S. port via vessel. Your customs broker can handle the actual ISF filing.

Additionally, many freight forwarders employ in-house brokers capable of clearing your freight and filing ISF, provided they hold a Power of Attorney (POA) for your company on record.

What information does the ISF form need?

The ISF, also known as ISF 10+2, mandates that importers furnish ten data elements to CBP and two documents from the goods’ carrier.

Here’s a breakdown of the required information for an ISF form:

From the importer or supplier:

  • Seller name and address
  • Buyer name and address
  • Supplier name and address
  • Ship-to name and address
  • Container stuffing location
  • Consolidator (stuffer) name and address
  • Importer of record number
  • Country of origin
  • Ultimate consignee EIN/IRS number(s)
  • Commodity Harmonized Tariff Schedule number

From the carrier:

  • Vessel stow plan
  • Container status messages

  • All ISF filings are submitted electronically.
  • Correct the mistake before goods arrive at U.S. ports.
  • Only the filer can make alterations to the filing.

Fines and penalties for late ISF filing

The CBP may impose substantial fines if the information is not transmitted at least 24 hours before loading the cargo.

It’s important not to delay filing even if you don’t have all the required information, as updates can be made until the cargo arrives in the U.S.

The penalty cost for late ISF filing can amount to several hundred dollars, even for smaller shipments. Any delivery delays will also result in additional fees. Therefore, you can include a clause in your supply contract that holds the supplier responsible for these costs if they are at fault.

Meanwhile, ensure that your freight forwarder files for Customs Entry before the ship arrives in port and that the information on the Commercial Invoice, Ocean Manifest, and ISF is consistent.
